Say what you will about Biden’s effort, but SCOTUS’ judicial activism in this case is worrying.
1. The “major questions doctrine” justices are invoking exists no where in the Constitution.
2. The “standing” claim by the plaintiffs is laughable.
3. The issue of “fairness” raised by Roberts is a far cry from the “balls and strikes” he said he would call, based purely on the laws as written. “Fairness” is political, not legal.
Irony is lost on the radical right.
