   As a former criminal defense attorney, I can explain the difference. Guilty means someone is charged with a crime, goes to trial, and found guilty by a jury. Liable means someone was sued for tortuous activity and the jury found in favor of the plaintiff, meaning the defendant was liable to the plaintiff for the damage caused by the tory.

   A civil case does not find guilt or innocence. So, yes, a jury found that the Tangerine Temper Tantrum committed a sexual assault. But the jury did not find that he was guilty of a crime. Trump was not being tried for a crime, because the statute of limitations for those crimes had passed many years ago.

   I’m sorry but I never brought race into the discussion. I did not say, or imply, any of the minstrel show mentality you imputed. I would have had the same reaction were it Justice Kavanaugh, Justice Sotomayor, Justice Roberts, Justice, Brown Jackson, or any of the other justices on the Supreme Court, because the question raised is color blind.

   Justices are supposed to avoid the appearance of impropriety. When Justice Thomas received these gifts, which he has acknowledge receiving, and did not report then, as he should have, he breached that duty and brought his impartiality into question.

   I believe that the cartoon is referencing the fact that Clarance Thomas classified the Anita Hill questions raised during his confirmation hearing as a “high-tech lynching for uppity blacks,” (his words not mine). Mr. Allie is claiming in the cartoon that the current furor over Clarence Thomas and Harlan Crow is the same sort of baseless “lynching” as happened during the confirmation hearing.

   I don’t agree with Mr. Allie, of course, but I am disheartened to realize I understand his thinking well enough to decipher this cartoon.

   Given that Harlan Crow’s organization filed numerous amicus briefs with the Supreme Court on several cases before it, every justice on that bench would know what Mr. Crow’s positions were on the matters. And would know how to vote if they, for some reason, wanted to gratify him.

   But your question ignores the more basic principle, all lawyers, up to and including Supreme Court justices, are supposed to avoid even the appearance of impropriety. Mr. Thomas’s accepting largesse from Mr. Crow for decades does not meet that standard and does cast a pall over his impartiality.

    I moderated a spotlight panel on Jon Provost at a comic book convention one year. I actually asked him, “Did Timmy ever actually fall down a well.” Jon answered, “Yes.” Then his wife, Laurie Jacobson corrected him and listed the several things Timmy fell down, concluding with, “But never a well.”
